Isteri fail kes mahkamah tuntut nafkah daripada suami


Dalam kebanyakan kes apabila isteri ditinggalkan oleh suami tanpa nafkah, maka langkah yang diambil ialah memfailkan cerai taklik atau fasakh sebagai jalan penyelesaian.

Di dalam kes di bawah ini, si isteri memilih jalan untuk memfailkan tuntutan nafkah di Mahkamah Syariah daripada suami dengan mengekalkan atau mempertahankan perkahwinan dan rumahtangga yang telah dibina.

Puan Fairus menyatakan bahawa beliau tidak menerima nafkah sejak berkahwin pada tahun 2004 dan seterusnya ditinggalkan suami sejak Ogos 2007.

Ini adalah antara langkah terbaik yang diambil oleh si isteri dengan mengambilkira bahawa suami mempunyai pendapatan tinggi dan mampu untuk menjelaskan nafkah isteri dan anak-anak walaupun terdapat risiko diceraikan oleh suami.

SEREMBAN 24 Sept. - Seorang suri rumah, Fairus Mohd. Yunus , 44, membuat tuntutan nafkah sebanyak RM5,000 sebulan di Mahkamah Rendah Syariah di sini terhadap suaminya, Mohd. Yusoof A. Razak, 60, yang merupakan pengusaha restoran terkenal di ibu negara.

Menurut peguam mewakili Fairus, anak guamnya berhak membuat tuntutan tersebut kerana dia masih merupakan isteri yang sah kepada usahawan tersebut.

''Kita serahkan kepada mahkamah untuk menentukan jumlahnya tetapi kita berpendapat RM5,000 merupakan angka yang sangat munasabah. Anak guam saya berhak berbuat demikian kerana dia masih lagi isteri kepada defendan.

''Berdasarkan kepada pernyataan tuntutan anak guam saya mendakwa yang defendan gagal memberi nafkah sejak mereka berkahwin pada tahun 2004," katanya kepada pemberita selepas sebutan kali ketiga kes tersebut di mahkamah syariah di sini, hari ini.

Berdasarkan pernyataan tuntutan itu juga, Muhammad Faiz berkata, anak guamnya turut mendakwa yang suaminya itu tidak lagi tinggal bersamanya iaitu sejak tahun lepas.

''Sejak Ogos 2007, defendan bertindak meninggalkan rumah mereka yang terletak di City Park, Seremban 2 dan sehingga kini defendan gagal untuk pulang ke rumah," katanya.

Sementara itu antara dakwaan Fairus terhadap defendan seperti mana terkandung di dalam pernyataan tuntutan yang difailkan sebelum ini ialah mengenai pendapatan defendan yang mencecah RM70,000 sebulan.

ISLAMIC law has been officially adopted in Britain, with sharia courts given powers to rule on Muslim civil cases.

The government has quietly sanctioned the powers for sharia judges to rule on cases ranging from divorce and financial disputes to those involving domestic violence.

Rulings issued by a network of five sharia courts are enforceable with the full power of the judicial system, through the county courts or High Court.

Previously, the rulings of sharia courts in Britain could not be enforced, and depended on voluntary compliance among Muslims.

It has now emerged that sharia courts with these powers have been set up in London, Birmingham, Bradford and Manchester with the network’s headquarters in Nuneaton, Warwickshire. Two more courts are being planned for Glasgow and Edinburgh.

Sheikh Faiz-ul-Aqtab Siddiqi, whose Muslim Arbitration Tribunal runs the courts, said he had taken advantage of a clause in the Arbitration Act 1996.

Under the act, the sharia courts are classified as arbitration tribunals. The rulings of arbitration tribunals are binding in law, provided that both parties in the dispute agree to give it the power to rule on their case.

Siddiqi said: “We realised that under the Arbitration Act we can make rulings which can be enforced by county and high courts. The act allows disputes to be resolved using alternatives like tribunals. This method is called alternative dispute resolution, which for Muslims is what the sharia courts are.”

The disclosure that Muslim courts have legal powers in Britain comes seven months after Rowan Williams, the Archbishop of Canterbury, was pilloried for suggesting that the establishment of sharia in the future “seems unavoidable” in Britain.

In July, the head of the judiciary, the lord chief justice, Lord Phillips, further stoked controversy when he said that sharia could be used to settle marital and financial disputes.

In fact, Muslim tribunal courts started passing sharia judgments in August 2007. They have dealt with more than 100 cases that range from Muslim divorce and inheritance to nuisance neighbours.

It has also emerged that tribunal courts have settled six cases of domestic violence between married couples, working in tandem with the police investigations.

Siddiqi said he expected the courts to handle a greater number of “smaller” criminal cases in coming years as more Muslim clients approach them. “All we are doing is regulating community affairs in these cases,” said Siddiqi, chairman of the governing council of the tribunal.

Jewish Beth Din courts operate under the same provision in the Arbitration Act and resolve civil cases, ranging from divorce to business disputes. They have existed in Britain for more than 100 years, and previously operated under a precursor to the act.

Politicians and church leaders expressed concerns that this could mark the beginnings of a “parallel legal system” based on sharia for some British Muslims.

Dominic Grieve, the shadow home secretary, said: “If it is true that these tribunals are passing binding decisions in the areas of family and criminal law, I would like to know which courts are enforcing them because I would consider such action unlawful. British law is absolute and must remain so.”

Douglas Murray, the director of the Centre for Social Cohesion, said: “I think it’s appalling. I don’t think arbitration that is done by sharia should ever be endorsed or enforced by the British state.”

There are concerns that women who agree to go to tribunal courts are getting worse deals because Islamic law favours men.

Siddiqi said that in a recent inheritance dispute handled by the court in Nuneaton, the estate of a Midlands man was divided between three daughters and two sons.

The judges on the panel gave the sons twice as much as the daughters, in accordance with sharia. Had the family gone to a normal British court, the daughters would have got equal amounts.

In the six cases of domestic violence, Siddiqi said the judges ordered the husbands to take anger management classes and mentoring from community elders. There was no further punishment.

In each case, the women subsequently withdrew the complaints they had lodged with the police and the police stopped their investigations.

Siddiqi said that in the domestic violence cases, the advantage was that marriages were saved and couples given a second chance.

Inayat Bunglawala, assistant secretary-general of the Muslim Council of Britain, said: “The MCB supports these tribunals. If the Jewish courts are allowed to flourish, so must the sharia ones.”

Seorang lelaki mempunyai 86 isteri dan 170 anak ditahan


Seorang lelaki setelah mempunyai 86 orang isteri dan 170 orang anak `baru' didakwa di Mahkamah Syariah di Nigeria. Bagaimana boleh berlaku perkara sebegini? Bagaimana pernikahan dibuat? Kenapa setelah lelaki tersebut mempunyai 86 isteri dan 170 anak baru perkara ini terbongkar? Kenapa tidak dari dulu lagi semasa beliau mengahwini isteri yang kelima atau keenam?

Pelik! Pelbagai persoalan bermain di minda saya. Apakah masyarakat di sana di kalangan mereka yang `baik' dan hanya `jaga tepi kain sendiri' sahaja? Kalau kain jiran sebelah menyebelah koyak rabak, pandai-pandailah jiran tersebut jahit sendiri. Biarpun sehingga menampakkan aurat!

Bagaimana peranan pejabat agama atau penguatkuasa agama? Adakah wujud badan-badan keagamaan milik kerajaan seperti itu? Yang bertambah pelik, berdasarkan berita tersebut lelaki itu tinggal dengan isteri-isteri berserta anak-anak di Bida... tinggal satu tempat atau daerah sahaja rupanya... jadi, mudahlah untuk dikesan dan dihidu kesalahan yang telah dibuat oleh Mohamad Bello oleh pihak berkuasa sepatutnya... saya kata sepatutnya ....

Saya teringat satu kes di Malaysia tentang seorang lelaki yang mempunyai lebih dari empat isteri... pada siri yang lain mungkin saya boleh kongsikan dengan pembaca-pembaca sekalian...

Nigerian court detains preacher with 86 wives(Agencies)

A Nigerian Muslim court Monday detained an 84-year-old Islamic preacher with 86 wives after he failed to heed a call by local leaders to divorce all but four of them.

The authorities in central Niger state charged Mohammed Bello with "insulting religious creed" and "unlawful marriages" after local chiefs and Muslim leaders gave him until September 7 to comply with Islamic sharia law, which allows a man to have no more than four wives at a time.

The preacher, who lives with his wives and some 170 children in the town of Bida, pleaded not guilty to the charges at an Upper Sharia Court in the state capital Minna.

Judge Abdul Imam, who rejected Bello's bail application and ordered that he be remanded in prison to allow police complete their investigation, adjourned the case to October 6.

Bello's detention came barely a week after he was granted temporary reprieve by a civil court in the Nigerian capital Abuja where he filed a petition against local chiefs and Muslim leaders who threatened to banish him if he failed to divorce 82 of his wives.

The preacher said the threats violated his right to life and personal liberty. The court gave Bello temporary protection from banishment, but the Niger State Sharia Commission decided on Monday to charge him at an Islamic court.

Bello had received a number of death threats after the Nigerian media began reporting on his unusual marital situation, his spokesman said.

Some newspapers said earlier in September that Bello had agreed at a meeting with local officials to divorce all but four of his wives and had asked for time to return them to their families.

But his spokesman later denied the reports and said the preacher intended to marry more wives instead.

His case has stirred controversy in Africa's most populous nation of 140 million people, roughly half of whom are Muslim. Many Muslim scholars say Islam allows men to have up to four wives at any given time who must be treated equally.
